(The title to land in question, other than a tree or shrub, shall not be deemed abandoned for a failure to file a petition to enforce the claims and the judge, before entering the judgment, shall first ascertain the rights, title and estate of the applicant, if the applicant is a natural person; may determine the character of his estate, and may enter judgment upon the nature of the estate. In such circumstances the title to the land shall be presumed to have been in existence prior to the filing of the petition.β) SECTION 58.
